1 WELCOME TO DRAGONBOX
1.1 Introduction
Kahoot DragonBox AS ("DragonBox") offers the interactive and digital learning tool DragonBox School. These Terms of Use ("ToU") apply to Users of the DragonBox School Application (the "App"). The terms "User", "you" and "your" refer to in this context any interaction with the App on behalf of yourself or a minor.
The App is delivered and operated by DragonBox. The App is a forward-looking learning platform that aims to create numeracy and joy of mathematics in children.
1.2 Briefly about the ToU
The ToU contains important information about the App and your use, as well as information about the rights and obligations of the User. Please read the ToU carefully before using the App.
The ToU include both private and educational use of the App, unless otherwise is agreed upon between DragonBox and the User.
By using the App, you acknowledge that you have read and understood the content of the ToU, and agree to be bound by the ToU. The ToU constitute a binding agreement between the User and DragonBox. If you do not accept the ToU, you may not use the App.
2 Using dragonbox
2.1 Account
In order to use the App, you must first create a DragonBox user account. To create a user account, DragonBox will ask you to register certain information about yourself. The requested information may include, but is not limited to, your name, address, mobile number and a valid e-mail address. You undertake to provide correct, true and accurate information. It is your responsibility to keep your information up-to-date.
The accountholder has access and control over the devices to which the App is connected. To ensure the security of your user account, you may not share passwords or other information associated with the user account with unauthorized persons.
DragonBox may terminate or suspend your user account to protect you, DragonBox or our partners from identity theft or attempted identity theft, or any other fraudulent activity under the ToU and applicable law.
2.2 User information
DragonBox will process information related to your account and your use of the App. To the extent User information constitutes personal data under the applicable data protection laws, such data will be handled in accordance with applicable data protection laws. 2.4 Schools and guardians' responsibility for children's use of DragonBox
DragonBox provides a tool for the use of guardians/parents and/or schools. Children are not regarded as fully independent users of the App. It is the schools' and parents'/guardians' responsibility respectively to ensure that the use of the App is in accordance with the ToU and to safeguard the children's safety and privacy. Apart from the limitations within the function of the App, DragonBox has no control over how parents/guardians or schools oversees the children's use of the App as DragonBox does not interact directly with the children using the App.
3 INTELLECTUAL PROPERTY RIGHTS
DragonBox is the sole owner and licensee of all intellectual property rights that appear in the App. This includes, but is not limited to concept, methodology, text, design, music, graphics, relevant interfaces and trademarks associated with DragonBox. The App may not be used for purposes other than those set out in the ToU or, if applicable, by special agreement with DragonBox.
4 LICENSED RIGHTS
Once you subscribe to a DragonBox service, we grant you a non-exclusive, non-transferable, revocable right to download, install and use the App and its features. This license applies to the use of the DragonBox Services for non-commercial, educational or entertainment purposes, unless otherwise agreed by the parties.
The App is licensed, not sold, to you. DragonBox, and DragonBox's licensors, retain ownership of all copies of the DragonBox App, even if you have downloaded the App to your personal computer, mobile, tablet and/or other relevant devices.
Your license to use the App will cease upon the expiration, suspension or termination of the ToU, or the termination or suspension determined in agreement with DragonBox.
5 Third parties and subcontractors
DragonBox may use third parties necessary to provide the App ("Third Parties"). DragonBox is responsible for Third Parties engaged by DragonBox. To the extent that Third Parties have access to any personal data, the handling of such data will be in accordance with applicable data protection and privacy laws. 6 tHIRD PARTY TERMS AND BENEFICIARY
This section applies to the use of any version of the App installed on, and compatible with, the iOS operating system of Apple Inc. ("Apple").
Apple is not the owner of the App and is not a party to the ToU. Apple is not in any way responsible for the App, except for any obligation to repay the purchase price of the App.
Apple is not responsible for support services or maintenance related to the App. Apple is not responsible for any other charges, losses, warranties, damages, costs or expenses in connection with the App. Apple is not responsible for any third party product liability claims, claims with respect to Intellectual Property Rights infringement or claims arising under consumer protection legislation or similar laws and regulations.
Any inquiry or complaint relating to the use of the App, as well as any complaints regarding intellectual property rights, must be directed to DragonBox.
The User License you are granted by the ToU is a non-transferable license to use the App on an Apple Product that uses Apple's iOS operating system and is owned or controlled by you or otherwise permitted in the 'Usage Rules' set forth in the 'App Store Terms of Service' (available here). Additionally, you must comply with any third party terms of agreement applicable when using the App, for example your wireless data service agreement.
You hereby understand and agree that Apple and its subsidiaries are third parties beneficiaries of these Terms. This means that as you agree to the ToU, Apple will have the right (and will be deemed to have accepted the right) to enforce them against you as a beneficiary of the ToU.
You hereby represent and warrant that you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country, and that you personally are not listed on any U.S. Government list of prohibited or restricted parties.
7 DRAGONBOX's obligations
The App and its features are offered on an 'as-is' basis. DragonBox strives to deliver a satisfactory and functioning product at all times. However, DragonBox cannot guarantee a flawless or uninterrupted use of the App. Access to the App or to specific features may be temporarily restricted or stopped without prior notice in the event of system failure, maintenance or repair or circumstances beyond DragonBox's control. In such cases, DragonBox shall not be liable.
DragonBox does not warrant that the App will be without loss, destruction, viruses, attacks, interference, hacking or other security threats. DragonBox has the right to implement measures to ensure the security of the App.
Although DragonBox strives to deliver correct and complete content, DragonBox cannot guarantee that the content will be accurate or complete at all times. Errors will be corrected by DragonBox within a reasonable time after DragonBox has become aware of the error.
7.1 Liability
To the extent permitted by applicable law, DragonBox is not liable to you, whether in contract, tort or otherwise, for the content of, the use of, or otherwise in connection with the App;
a) To the extent that you are using a free version of the App;
b) For indirect, special or consequential losses; Or
c) For business losses, loss of income, profits or expected savings, loss of contracts or business relationships, loss of reputation, or corruption of information or data.
Nothing in the ToU limits or eliminates the liability of DragonBox or anyone acting on DragonBox' behalf for intentional or grossly negligent acts or omissions.
8 CHANGES
8.1 Changes to the App
Updates and changes to the App may occur. The User of the App hereby understands and accepts that DragonBox is free to make changes and updates to the App if needed.
Changes to the App will not affect the rights and obligations between the User and DragonBox, as set forth in these ToU.
8.2 Changes to the ToU
Changes to the ToU may occur. Material changes will not be binding for the User without prior notice. The applicable ToU will be available on our website here.
8.3 Price changes
Current prices are presented on our website dragonbox.no. DragonBox may from time to time change the advertised prices. DragonBox will communicate any price changes to the User before they enter into force. Such price changes will take effect at the start of the next subscription period after the date of price changes.
To the extent permitted by applicable law, you agree to the price change by continuing to use the App and by renewing your subscription after the price change has come into force.
If you do not agree to the price change, you have the right to cancel your subscription.
DragonBox does not refund in cases where the price of an already purchased subscription falls, for example as a result of promotions. DragonBox does not refund in cases where we change the content or features of a subscription.
9 TERMINATION AND TERMINATION
9.1 Termination of the contract
The ToU will apply between DragonBox and user until the contract is terminated by either party.
DragonBox has the right to terminate the contract and prevent your access to the App and your user account if you act in violation of the ToU or applicable law. If DragonBox has reason to believe that you have acted in violation of the ToU, DragonBox has the right to take reasonable steps to protect the interests and rights of DragonBox and Subcontractors.
Article 2, 3, 4, 5, 8 and other articles of the ToU that explicitly or by their very nature must continue to apply even after the termination of the contractual relationship, shall continue to apply after the termination of the contractual relationship.
10 Right of withdrawal
When you purchase a subscription, you can instantly access DragonBox' learning systems. By ticking the box, you give your consent to and acknowledge that you give up your right of withdrawal. This means that you will have no right to withdraw from the purchase.
If you do not agree to waive your right of withdrawal, you will not be able to access the App.

11 GOVERNING LAW
Unless otherwise is required by applicable law, Norwegian law shall apply to the ToU and your use of the App.
12 Dispute resolution
Unless otherwise required by applicable law, disputes arising out of DragonBox or the ToU shall be governed by the courts of Oslo, Norway (Oslo Tingrett).
